Uhhhh, you do know that both of your choices are saying that Lee does hove chakra, right?
Anyway. In the Naruto universe, and in what humans nowadays consider chakra, Chakra is best described as "life energy". Most theories behind "chakra" say that all living things have chakra. The concentration is just different with all beings. So, seeing as how Lee is a living organism, I'm going to say that yes, he does have chakra. He just can't concentrate it to the point where he can do the otherworldly things like Ninjutsu and Genjutsu. Instead, he focuses entirely on the application of chakra on a body-wide scale, taijutsu. He uses his chakra every battle, we just can't see it physically like Naruto with his Rasengan or Sauske with his Chidori. The only time his chakra becomes physically seen is when he is using his hidden lotus technique, where the chakra in his body becomes so explosive that his litterally exudes from his body.

all ninjas have chakra, chakra is basically life energy. lee just cant use his chakra in ninjutsu..in other words he has poor chakra control

Lee has chakra but the thing is he cant use any of it cause he has no skill in nin or gen jutus.none what so ever. But you can that he does have chakra cause of the 8 gates. the 8 gates are chakra limiters that are opened forcing great amount of chakra through ones body as kakashi said.When he opens the chakra gates, Lee's skin turns red from the Large amount of chakra and the power and speed of his taijutsu techniques are enhanced. But Lee is just unable to use ninjutsu or genjutsu.
